Terms of use
Last updated: September 28, 2026 (draft)
Requires legal review before public launch. This is placeholder text for development. It is not a final legal document and must be reviewed by qualified counsel before PolicyChecked is offered to the public.
These terms govern your use of the PolicyChecked website and application (the "Service"). By creating an account or using the Service, you agree to these terms.
1. What the Service does
The Service lets you store and organize insurance documents, record listed policy and renewal information, receive optional renewal reminders, and request a review by a licensed insurance producer.
2. What the Service does not do
- It does not provide insurance, legal, tax, underwriting, or claims advice.
- It does not recommend any policy, carrier, coverage limit, or deductible, or evaluate whether your insurance fits your needs.
- It does not provide quotes or premium estimates.
- It does not bind, issue, modify, cancel, or renew any insurance policy.
- It does not accept premium payments or process claims.
- PolicyChecked is not an insurance company and does not represent any insurance carrier.
3. Licensed reviews
If you request a review, a licensed producer may contact you using the method you select. Any insurance advice, quote, application, or policy transaction happens only through that producer's authorized agency relationship, separately from the Service. Submitting a review request does not create coverage, bind a policy, guarantee a quote, or guarantee that coverage will be available.
4. Document summaries
A producer may publish a factual summary of information found in your uploaded documents. Summaries may be incomplete and depend on the documents you provide. Your actual policy documents control. A summary does not change your coverage.
5. Your account and your content
- You must provide accurate information and keep your password secure.
- You may upload only documents you are authorized to share.
- You keep ownership of your documents. You allow us to store and process them to provide the Service.
- Do not upload malicious files, or attempt to access other users' data or disrupt the Service.
6. Reminders
Reminders are based on the dates you or a producer enter. They are a convenience only. You remain responsible for tracking your policies with your insurer or agent.
7. Availability and changes
We may change, suspend, or discontinue parts of the Service. We will try to give notice of material changes.
8. Disclaimers and limitation of liability
[To be completed by counsel. This section must address service availability, the accuracy of user-entered and document-derived information, and limits of liability consistent with South Dakota law.]
9. Termination
You may close your account at any time from your account settings. We may suspend accounts that violate these terms.
10. Governing law
[To be completed by counsel. Expected: the laws of the State of South Dakota.]
